1. ABOUT US
We are independent developers creating mobile applications to help users enhance their photos. The App is provided as a free, ad-supported service.
2. ACCEPTANCE OF TERMS
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, including our advertising practices, you must not use the App.
3. LICENSE TO USE
3.1. Grant of License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on your mobile device.
3.2. Restrictions
You agree not to:
- Modify, reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices from the App
- Use the App for any illegal or unauthorized purpose
- Attempt to bypass, block, or interfere with advertisements
- Use ad-blocking software or modified versions of the App
- Use the App to process images that violate any laws or third-party rights
4. HOW THE APP WORKS
4.1. Third-Party AI Integration
The App uses third-party artificial intelligence services to enhance your photos. When you upload a photo:
- Your photo is sent to third-party AI services for processing
- The AI service enhances the image and returns the result
- The enhanced photo is returned to the App
- We do NOT store your original or enhanced photos on our servers
5. ADVERTISING AND MONETIZATION
IMPORTANT: This App is provided completely free of charge with NO in-app purchases or subscriptions. The App is supported by advertising revenue. By using the App, you agree to view advertisements as part of the service.
5.1. Types of Advertisements
The App displays multiple types of advertisements:
- Banner Ads: Small advertisements displayed at the top or bottom of screens (persistent, non-intrusive)
- Interstitial Ads: Full-screen advertisements shown between actions (NON-OPTIONAL)
- Rewarded Video Ads: Optional video advertisements that you can watch to earn credits or bonuses
Banner and Interstitial advertisements are NOT OPTIONAL and will appear automatically during your use of the App.
5.2. Ad Content Disclaimer
CRITICAL DISCLAIMER: We do NOT control the specific content of advertisements displayed by third-party networks. We are NOT responsible for:
- The content, accuracy, or appropriateness of advertisements
- Products, services, or websites advertised by third parties
- Any transactions, purchases, or interactions resulting from advertisements
- Technical issues or security concerns from ad networks
6. USER CONTENT AND PHOTOS
6.1. Ownership
You retain all ownership rights to your photos. By using the App, you grant us and our third-party service providers a temporary license to process your photos solely for the purpose of providing the enhancement service.
6.2. Prohibited Content
You agree not to upload or process photos that:
- Violate any applicable laws or regulations
- Infringe upon third-party intellectual property rights
- Contain obscene, pornographic, or sexually explicit content
- Depict violence, illegal activities, or harm to minors
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of data, photos, time, or productivity
- We are not responsible for actions or policies of third-party services
- Our total aggregate liability shall not exceed ₹500 (Five Hundred Indian Rupees)
9. PRIVACY AND DATA PROTECTION
Your use of the App is also governed by our Privacy Policy. Key points:
- We do NOT store your photos on our servers
- Your photos are processed through third-party AI services
- Third-party advertising networks automatically collect data about your device and usage
10. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
